Terrell Nance decd Last Will and Testament

To all whom it may concern
In view of the uncertainty of life, and the certainty of death
In the name and fear of God Amen
I Terrell Nance of Tippah County in the state of Mississippi being of sound mind
Do make and ordain this my last will and Testament revoking any and testamentary disposition
by me heretofore made.
1st My body I consign to the dust and my spirit I commend to God Who gave it
2nd My funeral expenses also testamentary including those of my last illness are first and
promptly to be paid and then my other debts.
3rd I give and bequest to my daughter Jennette J Sparks (in addition to that previously given)
fifty dollars.
4th I  give and bequest to the bodily heirs of Peyton T Nance Fifty Dollars to be equally distributed
5th I give and bequest to the child of my Daughter Louisa V(irginia) Jordan One Dollar
6th I give and bequest to my daughter Mary Ann D. Browder Fifty Dollars
7th I give and bequest to my daughter Martha O Newman One Dollar.
8th I hereby direct that at my death all of my personal effects be sold and that the foregoing dispositions be
paid out of the proceeds and the residue together with the Real Estate to be equally distributed amoung the
other remaining heirs viz: James H Nance, Jacob H Nance, John O(sbourne) Nance, Sarah E. E. McCown's children and George W Nance.
With the condition herein specified as follows. I give and devise to James H. Nance One Hundred dollars more and to
Jacob H Nance One Hundred dollars less than an equal share and to the children of Sarah E. E. McCown, a full share in the
last division to be distributed equally.
9th I nominate and appoint my son James H.Nance Executor of this my last Will.
In Witness whereof I hereinto set my name and seal this the 29th day of August A. D. 1877

The State of Mississippi

Tishomingo County

 

Art 1.     In the name of God, Amen.  I James Word of the County and State afore said being of sound and disposing mind thanks be to God for the same do make and ordain this my last will and testament in manner and former following to wit:  I assign my spirit into the hands of almighty God who gave it trusting and believing in the final holiness and happiness of all man kind through and by the merits of our Lord and savior Jesus Christ the 15th chapter 1st Corinthians 2nd chapter 1st Timothy 11th chapter Romans and my body to as decently buried by the side of my late beloved wife Jane B Word in the Iuka cemetery with out ostentation or show and a similar slab as the one set at the head of her grave set at mine by my executors here in after named -- 

 

Art 2.   As to debt I should owe none and should therefore give my executors out little trouble in that sense.  But my will and desire is that all my dues be collected as soon as possible without distressing my debtors unnecessarily so that my little affects may be divided among my children and grandchildren here in after named.  I have kept an account against each of them since they became of age or inter married which amounts may be found in a yellow bound ledger book in the back of my trunk.

 

Art 3.   My Son T. J. Word has had one thousand four hundred and sixty dollars $1460.00  my Daughter Ellen E Nance has had one thousand and eighty five dollars $1085.00 my Daughter Amelia Price has had Eleven hundred and thirty four dollars $1134.00 my Son Charles M Word has had two thousand nineteen dollars and fourteen cents $2019.14 my Daughter Sarah Jane Hutchens now divorced has had five hundred and seventy five dollars $575.00 which amounts may be considered as gifts or otherwise.

 

Art 4.  If so the amounts in said book will show my will and desire is that all my children and grand children here in named shall receive a sufficient amount out of my estate to make them equal to Charles M Word <to wit>

My son T. J. Word to have one share, My Daughter Ellen E Nance one share, My Daughter Amelia Price one share, Milles B one share, Nathan James and Mary Amelia Hutchens children of my divorced Daughter Sarah J Hutchens to have one share.

 

Art 5.  In case there should anything left after having made these all equal with my son Charles M Word then he is to come in and share equal with the other heirs herein mentioned.

 

Art 6.  I also will and bequeath to my Daughter Ellen E Nance a certain portion of my present residence for and during her natural life or so long as she may occupy the same <to wit> Beginning on a small hickory near the north east corner of my old garden on the east side of the road leading out of main street in Iuka turning an easterly corner with Mrs Nelson’s line to the north east corner of said garden, thence with the line of said garden a southern corner to outside fence fifteen feet beyond thence a parallel line with my outside fence a westerly corner to Hickory on the east side of the fore mentioned road thence to the said road to the beginning including dwelling out houses  ------  -- this not to be taken as any part off her legacy but is given in consideration of the trouble she has already had and may have in keeping house for me since the death of my beloved wife Jane B Word.  But in case of her death or removal off of said then it is to revert and become a part of my common estate and to be disposed of by executors herein after mentioned as other real estate manner in this instrument.

 

Art 7.   I hereby authorize and empower my said executors herein after mentioned to sell and dispose of all of my real estate which I may have purchased or seized off at public or  private sales they think best without any order of court or any other legal proceedings and on final and complete payment being made to make and execute title in fee simper to the purchaser or purchasers them and from payment not having been made that on complete payment being made, to make and execute title to the purchasers there of on the above terms.  I do hereby appoint W. P. Hanley and John T. Barnett my true and trusted friends executors to carry into effect this my last will and testament and my will and desire is that my said executors shall not as required to gain bond and security for the faithful performance of their duty having unshaken confidence in their moral honesty and dignity.                         This Writing is a Will made be me the 8th day February 1886 and I wish to write this as a codicil of the same.   I will to my daughter Ellen E Nance all the land contained in my present residence being land purchased of M. A. Simmons many years since and bounded as follows <to wit>  Beginning at a small Hickory on the west side of the road leading out of main street in the town of Iuka down the south west corner of Mrs. Nelson’s land turning a south east corner on her line to Branch Creek thence up said creek to J. T. Wraner’s land thence west to a small Red Oak opposite to Zllington Houses thence with road to the beginning containing 12 ½ Acers more or less also all the kitchen and house hold furniture all the stock corn and hay on hand and she is not to allow to my executors nor anyone else for any part of the farm I give it to her in fee simper to do with as she pleases for the trouble she has in keeping house and may have for me.  Signed sealed this 13th day March 1888.   James Word
